Applications regarding outstanding issues have been received as a result of directions in the transitional arrangements decision. These will be dealt with by the Commission as provided by the 4 August 2017 statement.

The Fair Work Commission is reviewing penalty rates in a number of hospitality and retail awards as part of the 4 yearly review of modern awards. This issue is being dealt with as part of a broader review of all modern awards as required under section 156 of the Fair Work Act 2009.
Penalty rates proceedings commenced in early 2015 and over 450 submissions and witness statements have been filed to date.
As part of the Penalty rates case the Commission is only considering the penalty rates provisions in specific awards in the hospitality and retail industries.
