Work-related allowances currently appear in modern awards as a percentage of the appropriate 'standard rate'. This methodology was introduced during the award modernisation process as required by clause 27 of the Minister's Request (see paragraph 27 of [2008] AIRCFB 717.)
Senior Deputy President Watson issued a Decision on 20 March 2013 in relation to the Transitional Review of the Electrical, Electronic and Communications Contracting Award 2010. The Review considered an application [AM2012/161 (4.08 MB)] to include the current monetary amount of all allowances in the modern award. In his decision, Senior Deputy President Watson said:
[41] As with the variation proposed by ECA in relation to the definition of transitional instruments, the issues arising from this variation application was discussed in conciliation and I advised ECA on 14 September 2012 that:
"Work is currently being undertaken within Fair Work Australia to prepare, for the assistance of award users, a table of monetary rates, derived from the specified percentages of the standard rate, for each modern award, which when completed would be available on the Fair Work Australia website, on the Awards page, and/or through a link within each modern award. This administrative step, when completed, would seem to meet the purposes of your first proposed award variation."
In accordance with this decision, staff of the Fair Work Commission commenced the preparation of documents which will provide the specific and current monetary amount of work-related allowances for individual modern awards. These allowances will be updated following the publication of any relevant wage increase.
